In execution of a Deed of Trust recorded in the Clerk's Office of the Circuit Court for the County of Warren, Virginia, as Instrument No. 110005785 (as assigned by Instrument No. 170002358), the undersigned, McCarthy & Akers, PLC, Substitute Trustee pursuant to Appointment of Substitute Trustee recorded as Instrument No. 180004022 in the aforesaid Clerk's Office, will offer for sale at public auction at the front door of the Warren County Courthouse, 1 E. Main Street, Front Royal, Virginia 22630, on the 31st day of August, 2018, at 1:00 p.m., certain property described in said deed of trust lying in the Town of Front Royal, County of Warren, Virginia, known as 22 & 30 W. Duck Street, Front Royal, Virginia 22630 (Tax Map Nos. 20A12-3-4, 20A12-3-5, and 20A12-3-6), and more particularly described in the aforementioned deed of trust.
As provided in the deed of trust and pursuant to the provisions of applicable law, the undersigned Substitute Trustee may exercise all of the powers, rights, authority, and duties granted in the deed of trust.

TERMS: Cash. A bidder's deposit of ten percent (10%) of the sale price may be required in cash at the time of the sale. Additional terms and conditions may be announced at the sale. Closing shall occur at the office of the Substitute Trustee within 15 days of the date of the sale, at which time the balance of the purchase price will be due and payable in cash. The property will be sold "AS IS" and will be conveyed by special warranty deed, subject to all liens, objections, rights, reservations, leases, covenants, conditions, easements, and restrictions superior to the lien of the deed of trust as they may lawfully affect the property. Neither the Substitute Trustee nor the holder of the note secured by the deed of trust will deliver possession of the property to the successful bidder. The purchaser at the sale will be required to pay all closing costs except the grantor's tax. Real estate ad valorem taxes will be prorated as of the date of closing. The Trustee reserves the right:

1. to waive the deposit requirement;
2. to approve the creditworthiness of any bidder and final purchaser;
3. to withdraw the property from sale at any time;
4. to keep the bidding open for any length of time.

In the event of resale, the deposit shall be forfeited by the defaulting purchaser and applied to the cost and expenses of the sale and the balance, if any, to be retained by the Trustee as compensation for said sale. Examination of title, conveyance and recording fees shall be at the expense of the purchaser. The purchaser shall assume any unpaid taxes for the current year subsequent to the date of sale. This sale is subject to any valid filed or unfiled mechanic's liens, if any, and other matters of record recorded prior to the aforesaid Deed of Trust.
