TO: Parties Unknown, who may be any persons or entities that would assert an ownership interest in the monies in the eight bank accounts.

The object of this suit is to seek declaratory judgment that the County of Shenandoah owns the monies held in eight bank accounts totaling approximately three million four hundred thousand dollars, which monies were paid to Mountain View Wholesalers, LLC, the Shenandoah County Sheriff, or his investigators in the course of an undercover criminal investigation conducted in Shenandoah County between December 2010 and April 2014, as more particulary described in the Complaint for Declaratory Judgment and other pleadings filed in the Shenandoah County Circuit Court in Timothy C. Carter, Shenandoah County Sheriff et al. v. Parties Unknown.

And, affidavit having been made and filed in accordance with Virginia Code § 8.01-316 that the Joint Motion to Join Third Parties filed by the County of Shenandoah and the Shenandoah County Sheriff states that while neither the Sheriff nor the County have specific knowledge of any other claimant, there are or may be persons whose names are unknown with an interest in the subject matter of this lawsuit, that such persons would be any person who claims to have any interest in the monies held in the eight bank accounts, and that such persons have been joined to this lawsuit as Defendant Parties Unknown, it is hereby ORDERED that Defendant Parties Unknown appear on or before fifty(50) days after entry of this Order and do whatever is necessary to protect their interests.

It is further ORDERED pursuant to Virginia Code § 8.01-317 that this Order of Publication be published once a week for four successive weeks in the Northern Virginia Daily, a newspaper of general circulation in the County of Shenandoah and that a copy be posted at the front door of the courthouse at Woodstock, Virginia.

In addition, sale shall be made subject to all existing easements and restrictive covenants as the same may lawfully affect the real estate. Property to be sold "AS IS" WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND. Property shall be conveyed to the purchaser by special warranty deed.

Terms of Sale: Cash, Cashier's or Certified Check at sale made payable to Hill and Rainey Attorneys. Certified funds must be presented to Trustee for inspection at the start of sale in order to be qualified to bid. Bidding Increments: Not less than $100.00. A deposit of $4,000.00, or 10% of the purchase price, whichever is less, will be required at the time of sale with settlement within thirty (30) days from the date of sale. Additional terms may be announced at the time of sale.
