ORDER OF PUBLICATION

The reason for this cause is to obtain service upon Salvador E. Cuellar having a potential interest in the property located in Shenandoah County, Virginia, and the secondary purposes of this cause are:

a) quieting title to the Property in favor of Bernabe Mendez and Johan Mendez as the fee simple owners of the Property as joint tenants with the right of survivorship under the Mendez Deed nunc pro tunc to June 9, 2014;

b) quieting title in favor of Farmers and Merchants Bank ("F&M Bank") under a Deed of Trust benefiting F&M Bank ("F&M Bank Deed of Trust") and ordering that the F&M Bank Deed of Trust constitutes a valid first priority lien encumbering the entire fee simple interest in the Property nunc pro tunc to June 9, 2014;

c) declaring that Bernabe Mendez and Johan Mendez are the fee simple owners of the Property as joint tenants with the right of survivorship under the Mendez Deed as nunc pro tunc to June 9, 2014;

d) declaring that the F&M Bank Deed of Trust constitutes a valid first priority lien encumbering the entire fee simple interest in the Property nunc pro tunc to June 9, 2014;

e) declaring that the F&M Bank Note binds Bernabe Mendez to the terms thereof and that Bernabe Mendez is the borrower under the F&M Note nunc pro tunc to June 9, 2014;

f) reforming each of the Mendez Deed, F&M Bank Note, and F&M Bank Deed of Trust to remove all references to Salvador E. Cuellar and to replace them with Bernabe Mendez including, without limitation, the signatures contained in the F&M Bank Note and the F&M Bank Deed of Trust;

g) in the alternative, imposing and subjecting the Property ot an equitable lien for purposes of securing repayment of the F&M Bank Loan;

h) in the alternative, imposing a constructive trust in favor F&M Bank, its successors, and assigns on defendants' interests in the Property and the benefits or proceeds thereof;

i) in the alternative, ruling that defendants have been unjustly enriched and ordering them to make restitution of the proceeds of the F&M Bank Loan; and

j) awarding plaintiffs such other and further relief as the nature of its case may require and to this Court shall seem proper, including an award of attorney's fees and costs.

Upon consideration whereof, this Order of Publication is GRANTED and it is

In execution of a certain Deed of Trust dated August 1, 2008, recorded in the County of Shenandoah, Virginia, in Deed Book 1715, Page 983, and amended in Deed Book 1755, Page 152, made by JK's Property Management, LLC, default having occurred in the payment of the Note thereby secured and at the request of the Beneficiary, the undersigned Substitute Trustee will offer for sale at public auction in the front of the building housing the Circuit Court of the COUNTY OF SHENANDOAH, VA located at 112 South Main Street, Woodstock, Virginia, 22664 on December 3rd, 2018 at 2:00 PM the property described in said deed of trust, located at the above mentioned addresses, with improvements thereon. Said real estate will be sold subject to all liens, encumbrances, conditions, easements and restrictions, if any, superior to the mentioned deed of trust, to the extent that they may be lawfully applied to the property. This sale is made subject to the right of the United States to redeem the property within one hundred twenty (120) days of the sale under Internal Revenue Code Section 7425(d)(1).

TERMS OF THE SALE: The real estate will be sold individually and in order as listed above, not all together. Neither the Substitute Trustee nor the holder of the note secured by the deed of trust will deliver possession of the property to the successful bidder. The purchaser at the sale will be required to pay all closing costs, including but not limited to title examination, recording costs (excluding Grantor's tax) and conveyancing which shall be by Special Warranty Deed. Seller shall not be responsible for any costs incurred by the purchaser in connection with their purchase or settlement, including, without limitation, state and local recording fees, title insurance or research, or any other costs of purchaser's acquisition. Real Estate taxes will be prorated as of the date of sale. The risk of loss or damage to the property passes to the purchaser immediately upon the conclusion of the Substitute Trustee's sale.

Terms: A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of sale. The balance of the purchase price will be due within thirty (30) days from the date of sale. Time is of the essence as to the closing date and the payment of the purchase price. If payment of the balance does not occur within thirty (30) days of the sale date, the Trustee reserves the right to forfeit the deposit, re-advertise and sell the property at the risk and cost of the defaulting purchaser. Trustee shall have no duty to obtain possession for purchaser. The property and the improvements thereon will be sold "AS IS" and without representation or warranties of any kind. Sale is subject to post-sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower(s) entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the Purchaser's sole remedy, in law or equity, shall be the return of the Purchaser's deposit without interest. The Trustee reserves the right to amend or supplement the terms of the sale by verbal announcement during the sale and modify the requirements for bidder's deposit. Pursuant to the Federal Fair Debt Collection Practices Act, we advise you that this firm is a debt collector attempting to collect the indebtedness referred to herein and any information we obtain will be used for that purpose.
